This Privacy Policy applies to the enterprises within RWS GmbH. If you have any questions in connection with the processing of your personal data, please contact the data protection team at RWS GmbH dataprotection@rws-tech.com.

This Privacy Policy applies to all processing of personal data in connection with any business transaction in all business units. It applies to the processing of personal data that has been received in the past or will be received in the future.

  • Communication: We may process personal data when you contact RWS GmbH or when RWS GmbH contacts you, for example if you contact our customer service or you write to RWS GmbH or contact us by telephone. In these cases we will ordinarily process the name(s) and contact details, as well as the content and time of the communication. We are entitled to use this information in order to be able to provide you with information, address your concern and communicate with you.
     
  • Visit to websites, use of apps: When you visit our websites or install and use an app from RWS GmbH, we may automatically collect information such as your browser version, the IP address of your computer, your internet service provider, the website from which you linked to our website, the duration of your visit to our website and what type of device you are using (such as a PC, smartphone or tablet and the installed operating system).

    We may also record which pages you accessed while visiting our website. This information can be used to improve the functionality of our website, for statistical purposes and within the framework of system administration. We may also use ‘cookies’. Cookies are small text files that are stored either temporarily or permanently on your device when you visit our website.     Information about your use of our website (such as your IP address) is transferred to Google servers and stored there when you access subpages that include the Google Maps service.     As soon as you view the e-papers provided by us, data is transferred to the Issuu server containing information about the time and duration of use.

  • Google Tag Manager: It is possible that Google Tag Manager will be used on our websites. Google Tag Manager is a service by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, US, i.e. by Google Ireland Limited with registered address in Gordon House, Barrow Street, Dublin 4, Ireland, if the service is made available in the European Union. Google Tag Manager enables us, as marketers, to manage website tags on one interface.     The query is used to distinguish whether an entry was made by a natural person or is abused by machine and automated processing.

    The service includes transfer of the IP address and, if applicable, further data required by Google for the reCaptcha service to Google and is carried out on the basis of our legitimate interest in determining individual personal responsibility on the internet and in preventing misuse and spam.

    Personal data may be transferred to the servers of Google LLC in the USA when Google reCaptcha is used.

  • Web fonts: External fonts may be used on our websites. They are used to improve presentation. Texts and fonts are displayed correctly in this way. The following providers may be used:

  • Contact form: If you use our contact form to contact us, we will ask you for personal information. In order for us to respond to your inquiry, you must provide a valid email address. Further information about yourself may be provided voluntarily.

    Your data will be processed by email. For technical reasons, it is not possible to guarantee that your contact information will be transmitted in an encrypted form. It is therefore theoretically possible that unauthorised third parties may become aware of or falsify the data. 

    Your data will be processed for the purpose of contacting us on the basis of your voluntary consent. By clicking the ‘Send’ button, you consent to the processing of your contact information for the above-mentioned purposes. If you do not agree, you must cancel the process. The contact form will not be sent, and your data will not be processed.

    Processing of the data contained in the contact form takes place exclusively on the basis of your consent. You may withdraw your consent at any time with effect for the future by contacting dataprotection@rws-tech.com.

    We use your data only as far as this is necessary for the processing of your inquiries and for further correspondence with you. The data collected by us for the use of the contact form will be stored for the purpose of processing the inquiry and in the event of follow-up questions and will be deleted under data protection law after your enquiry has been dealt with, unless there is another legal obligation to store it.
  • Use of email: We may use your name and your email address to send you messages, updates, invitations to events and our information. For this purpose, you are first asked to provide consent unless we have already obtained your contact details from you in another way in connection with our services. If you no longer wish to receive notifications from us, you may cancel the receipt of this marketing information at any time by clicking on the link contained in these emails. We may use external service providers to determine whether you open our emails or click on the links they contain. You can prevent this from happening by making the appropriate adjustments to your email client.
  • Newsletter: If you are offered the option of subscribing to a newsletter on our website and you register for any such newsletter, we may process the data we collect from you in this context.

    Your email address is the only required information to send you our newsletter. We are entitled to store your email address for the purpose of sending you our newsletter. The legal basis is your consent. Any other data and information – which is marked specifically – is provided voluntarily. They may be used to address you personally and to personalise the content of our email newsletter.

    We have recorded your consent and are obliged to keep its content available for retrieval at all times.

    If you register for an email newsletter, the personal data and information you provide and send to us may be collected and stored electronically by us. The purpose of this processing is initially to carry out the ‘double opt-in’ procedure, which you may use to consent to the regular receipt of email newsletters.

    In this procedure, we will send an email to the address provided by you once you have submitted your data and information. This email asks you to confirm that you do want to receive the newsletter. Your data will be erased if we do not receive confirmation of your registration.

    Once confirmation is received, we save your IP address and the time of the confirmation.

    The purpose of this procedure is to prove your registration for our newsletter and potentially to detect and prevent any abuse of your personal data. The legal basis is to preserve our legitimate interests or the legitimate interests of a third party.

    Kindly take note that we may evaluate how readers interact with our newsletter. To do so, the emails we send contact ‘web beacons’ or ‘tracking pixels’. These web beacons or tracking pixels are single-pixel image files that our service providers may make available to measure the performance of our newsletter. The servers run by the service provider Mailchimp (Mailchimp: operated by The Rocket Science Group LLC d/b/a Mailchimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA) are used for integration of the web beacon/tracking pixel and evaluation of which links in the newsletter are selected. This information is assigned to your email address and an individual ID for statistical and analytical purposes. The legal basis is your consent.

    This tracking will not take place if your email program blocks the display of images by default. The full newsletter will not be shown in this case, and you may not be able to use all of its functions. The aforementioned tracking is enabled as soon as you show the images.

    The data collected during registration (email address and voluntary details) is erased as soon as it is no longer needed for the purpose for which it was collected. This is the case if you cancel the newsletter or withdraw your consent.

    The data and information stored using the tracking function is stored for as long as you subscribe to the newsletter. We only store the data anonymously for exclusively statistical purposes once you have unsubscribed or withdrawn your consent.
  • Online shop: You may visit the online shop on our website to order products as a customer or a guest. Once you have registered, you can enter your email address and password to log in directly to our shop and place future orders, without having to enter your contact details again. Your personal data is then entered in an input mask, sent to us and then stored.

    When you place an order on our website, we collect personal data from you such as your title, first name, surname, email address, address and telephone number if you register with our shop.

    Your personal data is processed for the performance of the contract or to take steps prior to entering into a contract, for compliance with a legal obligation and to preserve the legitimate interest of RWS GmbH or a third party. 

    Your data will otherwise only be processed with your consent. You may withdraw your consent at any time with effect for the future. Your personal data will be erased as soon as it is no longer necessary for the aforementioned purposes, unless it is subject to statutory retention periods.

    You may also place orders as a guest, without prior registration. In this case, however, you must enter your details each time that you place an order.

    We process the details you provide when placing an order as a guest for the performance of the contract or to take steps prior to entering into a contract. We store the information you provide for the period of processing and fulfilment of your order. Your personal data will then be erased, unless it is subject to statutory retention periods.

    We may use various services from service providers for the operation and optimisation of our website and our services and for the fulfilment of contracts. In doing so, it is necessary to transfer data to them that is required for the fulfilment of tasks, in particular for central IT services, the hosting of our website and for the delivery of products.

    We make efforts to ensure the highest possible security standards when transferring your personal data in this way.

    We can assure you that these service providers have been carefully selected by us and bound to contractual obligations. Where a company acts as a processor on our behalf (e.g. for hosting the website), we guarantee that appropriate data protection safeguards and data security measures have been agreed with the companies commissioned by us. We transfer the personal data required for the delivery of ordered goods (e.g. the first name, surname and address) to logistics companies and the parcel/postal service provider specified in the order, such as DHL, DPD, UPS and Hermes. This is necessary in particular to preserve our legitimate interests or the legitimate interests of a third party.
  • PayPal as a payment method: If you choose to make payments using the online payment service provider PayPal during the order process, your contact details will be transferred to PayPal as part of this order. PayPal is a service of PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. In this case, PayPal acts as an online payment services provider as well as a trustee and offers buyer protection services.

    The personal data transferred to PayPal is usually the first name, surname, address, telephone number, IP address, email address or other data required for order processing, as well as data related to the order such as the number of items, item numbers, invoice amount, tax rate (%) and billing information, etc.

    The transfer of this data is necessary for fulfilment of your order based on your selected payment method, in particular to confirm your identity, to manage your payment and to cultivate the customer relationship. 

    Please bear in mind that PayPal may also disclose personal data to service providers, subcontractors or other affiliated companies to the extent that is necessary for performance of the contractual obligations arising from your order or if a processor handles your personal data.

    PayPal will transfer the personal data it receives to credit check companies, depending on the payment method selected via PayPal (e.g. purchase on account or direct debit).

    This transfer is used to check your identity and creditworthiness for the order placed by you. Refer to the PayPal privacy policy at https://www.paypal.com/de/webapps/mpp/ua/privacy-full to learn which credit check companies are involved and which data is processed by PayPal in general.
  • Visiting our buildings: When you enter our buildings, we make video recordings in designated areas for reasons of security and verification. Furthermore, your name, address, employer, title, identification information, copies of documents, government issued documents, mobile and telephone number(s), date of birth, all citizenships (including former citizenships), nationality(ies) (including former nationalities), residence permit(s) and your home address may be collected and stored when you enter/sign in to our buildings. We use this personal data for security reasons and for compliance with legal requirements (trade compliance). You are also given the opportunity to use a Wi-Fi service. If you do so, we collect device-specific information and ask you to provide your name and email address during registration.
  • Customer events: We may also process personal data when we hold customer events (such as promotional events, sponsorship events, cultural events and sporting events).

    This data may include the name and address of participants or interested persons and other information such as your date of birth, depending on the event.

    We may process this information for the purpose of holding customer events, but also to contact you and build a relationship with you. Refer to the terms and conditions of participation for more information.
  • Business partners: RWS GmbH cooperates with a variety of companies and business partners, including suppliers, trade customers for goods and services and service providers (for example IT service providers). We may process personal data about the contact persons at these companies, including their name, function, all citizenships (including former citizenships), nationality(ies) (including former nationalities), residence permit(s), home address and title.

    We may be required to carry out more thorough vetting of a company and/or its employees, depending on the area of activity in question.

    We will notify you separately if this is the case. Further, we may process personal data about you to improve our customer focus, customer satisfaction and customer loyalty (‘customer relationship management’).
  • Administration: We may process personal data for administration purposes at our company. For instance, we may process personal data in connection with IT or facility management. We may also process personal data for the purpose of invoicing and archiving and generally to review and improve our internal workflows.
  • Corporate transactions: Personal data may also be used for the preparation and processing of corporate and other transactions.
  • Applications: We may also process personal data if you apply to work for us. In general, we require the usual details and documents, as well as the information stated in the classified ad. Kindly read our Privacy Policy for Applicants (the link was provided earlier on in this document). This policy contains information about how we process personal data collected as part of an application.
  • Employment relationship: We process personal data of our staff within the framework of the employment relationship. A specific RWS GmbH Privacy Policy applies in these cases.
  • Compliance with legal obligations: We may process personal data for compliance with legal obligations. This includes, for example, the operation of a whistleblowing system for indications of suspected misconduct, internal investigations or the disclosure of documents to a public authority if we are required to do so for good cause or compliance with a legal obligation. We may process names, documents or accounts that refer to you or third parties in this context.
  • Protection of rights: We may process personal data in various circumstances in order to protect our rights, for instance to exercise claims in or out of court or to defend claims against us. For example, we may conduct a review to ascertain the prospects of litigation or submit documents to an authority. Authorities may also oblige us to disclose documents containing personal data.

We process personal data on the following bases:

  • for performance of a contract
  • due to legitimate interests. Included in this are, for instance, our interest in customer care and communication with customers outside of a contractual relationship, marketing activities, in measures to establish a stronger connection with our customers and other persons, in improving products and services and developing new ones, in combating fraud and in preventing and investigating criminal offences, in protecting customers, staff and other persons and data, secrets and the assets of RWS GmbH, in ensuring IT security, in particular in connection with the use of websites, apps and other IT infrastructure, in protecting and organising business processes, including the operation and further development of websites and other systems, in managing and developing the company, in the sale or purchase of companies, parts of companies and other assets, and in the enforcement of or defence against legal claims.

    You are not required as a rule to disclose personal data to us. We must however collect and process certain data in order to enter into and perform a contract and for other purposes.

4. With whom do we share your personal data?

Our employees have access to your personal data to the extent that this access is necessary for the purposes described and for the work of the particular employee. They act according to our instructions and are obliged to maintain confidentiality and secrecy in the handling of your personal data.

In addition, we may transfer your personal data to external service providers who carry out certain business transactions on our behalf (‘processors’), in particular:

  • IT services, such as data storage, cloud services and data analytics, etc.
  • consulting services such as those provided by tax advisers, lawyers, management consultants and recruiters
  • logistics services for the shipment of goods
  • administrative services such as facility management
  • credit check companies and collection services.

There are also other examples of cases in which we may disclose your personal data:

5. When do we disclose your personal data in third countries?

The recipients of your personal data (Section 4) may be located abroad – also outside of Switzerland, the EU or the EEA – where the legal system does not afford the same comprehensive protection of your personal data as in Switzerland, the EU or the EEA.

Where we disclose your personal data to recipients in these countries, we ordinarily conclude a data transfer contract to ensure adequate protection of your personal data, including the contracts. 6. How do we protect your personal data?

We implement suitable technical and organisational measures to guarantee the security of your personal data and to protect it against unauthorised or unlawful processing, as well as to mitigate the risk of loss, accidental modification, unintentional disclosure or unauthorised access.

7. For how long do we store your personal data?

We do not store your personal data for longer than is necessary for the purposes for which the information was collected or for compliance with statutory retention periods.

Where you have given us your consent, we store your data until you withdraw your consent, provided there is no other legal basis for processing your data and no statutory retention periods prevent its erasure.

8. What are your rights in regard to your personal data?

You have the following rights, within the limits of applicable law: You may, among other things, obtain access to your personal data processed by us, instruct us to rectify or erase it, request that the personal data you have provided to us be returned to you in a structured, commonly used and machine-readable format or transferred to a person of your choice. You may also withdraw your consent to the processing of your personal data by RWS GmbH. You also have the right to lodge a complaint with a supervisory authority responsible for data protection concerning the way in which we have used your personal data.

We do not use automated decision-making or profiling.

11. Changes to our Privacy Policy

We reserve the right to change our security and data protection measures if this becomes necessary due to technical developments. In such cases, we will also adapt our privacy policy information accordingly. Please therefore note the current version of our Privacy Policy.

11. Important information according to Art. 13 General Data Protection Regulation (GDPR) for the organisation of competitions.

We collect personal data (surname, first name, date of birth, country and email address) to enable your participation in the competition.

Pursuant to Art. 6 para. 1 point a) to c), GDPR, we are authorised to collect, store and transfer personal data if the data subject has consented to processing or for compliance with a contract or legal obligation.

Your personal data will be stored and used for receipt of electronic newsletters, as well as to hold the competition, and can be erased at any time upon personal request. The contact address to do so is info(at)rws-tech.com

The winner must provide their postal address for the distribution of prizes. The winner’s data will be stored according to the statutory retention periods.

Your data will only be used for the purpose of the competition and not for any other purpose, unless you have opted to receive a newsletter and have consented explicitly to this use. Your data will only be transferred to third parties if this is necessary for organisation of the competition (e.g. web agencies). A transfer to other third parties does not take place.

Furthermore, your data will be transmitted to internal departments involved in the execution of the respective business processes, e.g. bookkeeping, accounting, shipping office and IT. There are retention periods prescribed by tax and commercial law if you were picked as a winner. These are 10 years for accounting documents according to Section 147 para. 1 German Fiscal Code (AO) and 6 years for business documents according to Section 257 para. 1 German Commercial Code (HGB).

Participants are entitled at any time to obtain information concerning the status of their stored personal data and to demand its erasure. Their continued participation in the competition will not be possible in this case. The request for blocking/erasure (withdrawal of consent) must be sent to the following email address: info(at)rws-tech.com.

Subscription to the newsletter is voluntary and must be regarded as a ticket for participation in the competition. The first names, surnames and email addresses of participants who have signed up additionally for a newsletter as part of participating in the competition will be used exclusively to send the aforementioned newsletter and stored until consent is withdrawn by the recipient. Consent may be withdrawn by clicking on the unsubscribe link in the footnote to the email. It is declared by sending a message to info(at)rws-tech.com without adherence to any formal requirements.
